1. Who we are, and what this covers
The responsible party has not been configured, so this policy does not identify a data controller — which is a requirement, not a formality. Set NUXT_PUBLIC_LEGAL_NAME, NUXT_PUBLIC_LEGAL_ADDRESS, NUXT_PUBLIC_LEGAL_EMAIL, NUXT_PUBLIC_LEGAL_JURISDICTION in the deployment environment.
These Terms cover the Colada website, user accounts and shared catalogue ("the Service"). The Colada desktop application is separate software with its own Terms, which you accept the first time you run it and which govern how you use it — including what you may lawfully download.
2. The account is optional
Colada works fully without an account. Signing up adds profile settings, privacy controls and the ability to manage what you have shared. You must be 16 or over to create one.
Keep your password to yourself; you are responsible for activity under your account. Tell us if you think someone else has access to it.
3. What it costs
The Service is currently free. We may introduce paid plans in future. If we do: existing features you rely on will not be moved behind a paywall without notice, we will tell you in advance, and nothing will ever be charged without you explicitly agreeing to it first.
4. Acceptable use
You agree not to:
- attack, overload, probe or attempt to gain unauthorised access to the Service
- submit false, misleading or deliberately corrupted data to the shared catalogue
- use the Service to infringe copyright or any other person's rights
- scrape or bulk-extract data beyond ordinary use of the interface
- impersonate anyone, or create accounts on someone else's behalf without their permission
We rate-limit requests to keep the Service available. Serious or repeated abuse may cost you access.
5. The shared catalogue
With sharing switched on, the app contributes information about recordings in your library — title, artist, album, genre, mood analysis, lyrics and embedded cover art — to a shared catalogue used to improve metadata for everyone.
By contributing you confirm you have the right to share that information, and you grant us a non-exclusive, worldwide, royalty-free licence to store it and make it available through the Service. You keep whatever rights you already had. We claim no ownership of the underlying music, and the catalogue contains no audio — only descriptive metadata.
Contributions are recorded against a source, never a person, so once contributed they cannot be traced back to you and cannot be individually withdrawn. If you believe the catalogue holds material that infringes your rights, contact us and we will remove it.
6. Your data
How we handle personal data is set out in the Privacy Policy, which forms part of these Terms. In short: usage sharing is off unless you turn it on, we sell nothing, and you can delete everything.
7. Availability
The Service is provided as is, with no guarantee of uptime. It runs on a single server: maintenance, updates and faults will cause interruptions, and we do not offer a service level agreement. Nothing you rely on should depend on it being available at a particular moment.
We take backups, but you remain responsible for your own data. Your music and library live on your computer, not with us — which is the entire point of Colada's design.
8. Liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, lost profits, or anything arising from your use of the Service. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
If you are a consumer, you keep all rights the law gives you and nothing in these Terms takes them away.
9. Ending it
Close your account whenever you like from Account → Delete my data. We may suspend or close an account that breaches these Terms, and will tell you why unless we are legally prevented from doing so. If we discontinue the Service we will give reasonable notice and a way to export your data first.
10. Changes
We may update these Terms. Material changes will be announced here with a new version number and, where they affect your rights, notice before they take effect. Continuing to use the Service after that means you accept the new version.
11. Law and disputes
These Terms are governed by the law stated in section 1. If you are a consumer you may also bring proceedings in your country of residence. Let's try to sort out any problem by email before it becomes anything more formal.
